Is a driver required to anticipate another driver’s actions to avoid a collision?

British Columbia, Canada

The following excerpt is from Doyle v Hubick, 2022 BCSC 309 (CanLII):

Another frequently cited principle relevant here is that “[a] driver will not be held to have breached the standard of care simply because he or she failed to take extraordinary steps to avoid an accident or to show exceptional proficiency in the operation of a motor vehicle”: Salaam at para. 25. Relatedly, drivers are “not required to anticipate another driver’s negligent manoeuver”: Ali v. Fineblit, 2015 BCSC 1494 at para. 20.
