As to Mr. Justice Wilson’s decision that the pleadings failed to disclose any reasonable claim, paragraphs 6, 7, 8, 12 and 13 are of particular relevance. As I read these reasons, Wilson J. decided that the allegations made by the plaintiff were wild speculation and were incapable of proof. In doing so, he relied on the reasoning of Thackeray, J.A. in Young v. Borzoni 2007 BCCA 16. Central to Wilson J.’s decision that the allegations were mere speculation was the fact that the allegations were directed against all of the defendants but without stating when, where or how the wrongful acts are alleged to have been committed or by whom.
