The Plaintiffs argue that, in order to maintain public confidence, the courts must exercise their inherent jurisdiction to preserve the integrity of the system by preventing conflicts and the appearance of conflicts, pursuant to principles enunciated in MacDonald Estate v. Martin, 1990 CanLII 32 (SCC), [1990] 3 S.C.R. 1235. They also cite Chapter 6 of the Law Society of Alberta Code of Professional Conduct in which it is stated that "in each matter, a lawyer's judgment and fidelity to the client's interest must be free from compromising influences".
