Counsel for the plaintiff submits that the defendant has purposefully failed to disclose the value of his grandmother’s assets save and except the sale price of her condominium. He relies on the line of authority as set forth in Cunha v. daCunha and Novin v. Novin to suggest that the operating assumption should be that the amount of assets not disclosed was at least equal to the amount disclosed. He further submits that the condominium proceeds were a contingent asset at the time of the triggering event.
