There is also the possibility that in the future the plaintiff would prefer the container gate foreman position over the ship foreman job position due its stable, Monday to Friday, 40-hour-a-week nature being a better fit for his lifestyle and personal preferences. The following awards reflect the multiple contingencies noted, and the uncertain, limited wage comparison data upon which the court is called upon to rely. These awards also bear in mind the four Brown v. Golaiy capital asset approach consideration factors cited in Hoy, the most relevant of which given the stability of the plaintiff's job being: i) whether the plaintiff has been rendered less capable overall of earning income from all types of employment; and ii) whether the plaintiff has lost the ability to take advantage of all job opportunities that might otherwise have been open.
