What is the test for control of words on a headstone?

British Columbia, Canada

The following excerpt is from Wiebe v. Bronstein, 2013 BCSC 1041 (CanLII):

The plaintiff argues that the placing of the plaque is an intrinsic part of the Jewish burial ceremony and therefore falls within s. 5 of the Act. He relies on Kartsonas v. Kartsonas Estate, 2010 BCCA 336, in support of the proposition that the section should be read broadly and should include the control of the words to be engraved on the headstone.
