The plaintiff submits that on an application for a garnishing order before judgment one does not inquire into the merits of a claim. The only issue is whether the claim advanced is for a liquidated sum. That there may well be defences to the claim is irrelevant. She references Hans v. Dynegent Technologies Inc., 2008 BCSC 494.
