Can a court order the production of a statement of intent to pervert the course of justice?

British Columbia, Canada

The following excerpt is from Oswell v. 488780 B.C. Ltd., 1998 CanLII 4346 (BC SC):

In light of all of this I am satisfied that the only way for the petitioners to obtain this statement is if it is ordered to be produced. I am satisfied this falls within the exceptions referred to by Mr. Justice Bouck in the Steeves v. Rapanos decision.
