62. The owner is particularly concerned with the amount of time that has elapsed since it first reported a sewage backup in September 2016. However, the strata relies on the decision in Leclerc v. The Owners, Strata Plan LMS 614, 2012 BCSC 74 in which the court said with respect to a strata’s delay that a strata is not required to be perfect, but it must take reasonable action and have fair regard to the interests of all concerned.
