In what circumstances will a motor vehicle be insured in the absence of a safety check?

Alberta, Canada

The following excerpt is from Westrop-McKay v. Barrett, 2001 ABQB 81 (CanLII):

In the case at bar the truck in question was required to undergo a safety check before it could be insured, as it was more than ten years old. Therefore, in this case, as in the Budny v. Senechal case, the last three steps had not been completed. That led Carter J. in Budny to conclude that the registered owner was to be held responsible as an owner: ... and that the indicia of his ownership are the registration of the motor vehicle in his name; the fact that he allowed the licence plates registered in his name to continue to be affixed to the motor vehicle; the fact he did not cancel his insurance but allowed it to expire; the fact that he continued to be concerned about whether his brother had fulfilled the verbal conditions agreed between them.
