The officer’s failure to consider whether the applicant’s position met the qualities of a senior executive or manager and her use of inappropriate criteria in assessing the applicant’s application is not a decision making process demonstrating justification, transparency and intelligibility as required by the reasonableness standard of Dunsmuir v. New Brunswick, 2008 SCC 9, [2008] S.C.R. 190 at paragraph 47.
