While a review of the legislation and the case law would indicate there is no obligation that the offer be served or delivered to counsel, the defendants say that Serra v. Paniccia (1999), 45 C.P.C. (4th) 219, states the contrary. However in my review of the case, I note because the offer was not in writing, it could not be served.
