Further, I find that the allegations related to “subbing up” and the meeting in January 2008, are not of the same character as the timely allegations and therefore there is no continuing contravention in regard to these allegations. Also, in regard to the October 2007 allegations, I find that the length of time between these allegations and the timely allegations is significant and, therefore, they are not part of a continuing contravention: Dickson v.
