Although the question of the necessity for leave was not mentioned in Nelson v. Canada, 2006 BCCA 442, 152 A.C.W.S. (3d) 564, it appears that in that case an appeal from a chambers judge’s order denying leave to a vexatious litigant proceeded without leave.
