Given the factual matrix before me, sections 129, 144, 146 and 127 of the Motor Vehicle Act are most instructive. While these provisions do not set out an exclusive code relating to the prudent course of conduct for motorists, they do supplement the common law duty to exercise due care: see Hmaied v. Wilkinson, 2010 BCSC 1074 at para. 21.
