This places the agency and the Ministry responsible as guardian, under the same constraints and obligations as those of the parent. These obligations have been explicitly defined in Young v. Young, 1993 CanLII 34 (SCC), [1993] 4 S.C.R. 3. They are obliged to consider the best interests of the children and obliged to consider their best interests as a paramount consideration.
