19 As to the merits of the appeal I think the appellants have a difficult case to put it at its best from their viewpoint. I am not prepared to say it is "virtually hopeless" (see Legg J.A. in Gibson v. Henniger, [1996] B.C.J. No. 1634, B.C.C.A. No. CA021234, February 16, 1996, para. 9) and thus could be termed frivolous.
