Although the limitation period, may be extended where there is evidence of some other form of disability rendering the claimant incapable of taking legal action, the chambers judge, in this case, correctly concluded that there was no such evidence to support a finding of disability. There is no reasonable explanation as to why the appellant could not have endured the costs and strain of litigation within the limitation period: Novak v. Bond, 1999 CanLII 685 (SCC), [1999] 1 S.C.R. 808.
