The following excerpt is from Daum v Borsuk, 2020 BCSC 2013 (CanLII):

In any event, even if the plaintiff could prove a breach of a statutory duty, that does not constitute negligence and there is no recognizable action for negligent breach of a statutory duty. Public bodies’ decisions about what acts to perform under a statute are policy decisions that do not give rise to liability in negligence: Holland v. Saskatchewan, 2008 SCC 42 at paras. 9, 14.
