The case law is clear that for this argument to succeed, there must be a complete absence of evidence to support the jury verdict. To put it another way, the verdict must not have any evidentiary support: see Sandhu v. Wellington Place Apartments, 2008 ONCA 215 (CanLII), 234 O.A.C. 200, at paras. 10-11.
