In Matheos v. Pottle the issue was whether the defendant was entitled to a second examination by a doctor of physical rehabilitation in medicine when the defendant had already had the plaintiff examined by an occupational therapist and there was nothing in that report that appeared to dictate a further assessment. Again, that is not the situation here.
