I shall consider first the arguments that the issue in this proceeding is now moot. Although articulated in the context of a constitutional challenge, the principles governing mootness established in Borowski v. Canada (Attorney General) 1989 CanLII 123 (SCC), [1989] 1 S.C.R. 342 are equally applicable to challenges to the exercise of public power made on administrative law grounds.
