I am satisfied that the successful moving party should be entitled to costs although I am not convinced that these should be fixed on a substantial indemnity basis. The insurer’s behaviour in this case cannot be compared with that of the insurer’s conduct in the Murphy v. Beeton case cited by the moving party.
