The following excerpt is from Bank of Nova Scotia v. British Columbia (Superintendent of Financial Institutions), 2001 BCSC 1517 (CanLII):

In Canadian National Railway v. Harris, 1946 CanLII 43 (SCC), [1946] S.C.R. 352 (S.C.C.) at p. 386, Estey, J. remarked that which is incidental is something which is usually or naturally associated with or arising out of the work. The learned judge adopted the Oxford English Dictionary definition of incidental as follows: something occurring or liable to occur in fortuitous or subordinate conjunction with something else.
