Driving is a regulated activity; drivers have a responsibility to observe the standards of care required of all licenced drivers (Hundal at pp. 884, 888). While not determinative, provincial traffic laws help inform what is recognized to be safe and unsafe driving in a given situation (Galaske v. O’Donnell, 1994 CanLII 128 (SCC), [1994] 1 S.C.R. 670 at 687-88).
