When dealing with an asset in a volatile market, rising or falling or both, it would be unrealistic and possibly unfair to be confined to a predetermined date unless there is a legal requirement to select such date: Johnson v. Agnew, [1980] A.C. 367, [1979] 2 W.L.R. 487, [1979] 1 All E.R. 883(H.L.).
