In response, the first fatal accidents legislation was enacted in the United Kingdom which provided a statutory cause of action for certain designated family members of the deceased who had suffered a wrongful death, against a tortfeasor who had caused the fatal injury. A summary of this statutory development in both the United Kingdom and Canada is set out in Cable Estate v. Ferguson, 2008 ABQB 343, 301 D.L.R. (4th) 746.
