The first question arises out of the common-law defence of duress, which the appellant raised at trial. The defence is available to the appellant by virtue of s. 8(3) of the Criminal Code: Paquette v. The Queen (1976), 1976 CanLII 24 (SCC), [1977] 2 S.C.R. 189; 30 C.C.C. (2d) 417.
