In a subsequent case, Makowsky v. Jaron, 2004 BCSC 419, the infant settlement was approved by Melnick J. while the fee approval application, in the absence of counsel for the defendant, was approved by Groberman J. That procedure would appear to confirm that the two applications involve distinct and different processes.
