This case raises the question of which level of government has the jurisdiction to review and approve the Condominium Plan. The federal government has exclusive jurisdiction over aeronautics pursuant to the “peace order and good government” clause of the Constitution Act: Johannesson v. West St. Paul (Rural Mun), 1951 CanLII 55 (SCC), [1952] 1 S.C.R. 292 at 308, 312, 328. The provinces have exclusive jurisdiction over local planning (section 92(13) or (16) of the Constitution Act).
