With respect to subsection 17(4) of the Federal Court Act, this proceeding is not in the nature of an interpleader action which is generally the nature of proceedings contemplated by subsection 17(4). However, Roberts v. Canada, 1989 CanLII 122 (SCC), [1989] 1 S.C.R. 322 is authority for the principle that a fact situation may fall within subsection 17(4), notwithstanding that the matter is not in the nature of an interpleader proceeding.
