What factors will the Court consider in deciding whether to grant an appeal?

British Columbia, Canada

The following excerpt is from Medar v. Ionescu, 2014 BCCA 428 (CanLII):

The factors to be considered on cases of this sort, as set out in Redpath v. Redpath, 2008 BCCA 400 at para. 15, are: 1. whether there was a bona fide intention to appeal, 2. when the respondents were informed of the intention, 3. whether the respondents would be unduly prejudiced by an extension, 4. whether there is merit in the appeal, and 5. whether it is in the interests of justice an extension be granted.
