I start by highlighting the essential elements of a conspiracy, which is an agreement by two or more persons to do an unlawful act. There must be an intention to agree, the completion of an agreement and a common design. To conspire is to agree. The essence of criminal conspiracy is proof of an agreement: see United States of America v. Dynar, 1997 CanLII 359 (SCC), [1997] 2 S.C.R. 462 at para. 86.
