The essential elements of a cause of action for false imprisonment are set out in Ernst v. Quinonez, [2003] O.T.C. 847, [2003] O.J. No. 3781 (S.C.), at para. 93. A party alleging false imprisonment must prove that: (a) the plaintiff was totally deprived of liberty; (b) the deprivation was against the plaintiff's will; and (c) the deprivation was caused by the defendant.
