In many cases there may be no practical difference between warranties of fitness for purpose and merchantable quality. However, these warranties can apply in different circumstances and can provide differing degrees of protection: Wharton v. Tom Harris Chevrolet Oldsmobile Cadillac Ltd., 2002 BCCA 78 at para. 33.
