In my view the delay was lengthy and inordinate. By the time of trial approximately 10 years will have passed since the material events underlying the claim occurred. Until recently no efforts have been made by the plaintiffs to move the claim forward. In addition, as noted in Bawtinheimer v. McEachern, 2011 BCSC 1807, the expiry of the limitation period, as is the case here, is a relevant factor.
