The following excerpt is from Williams Medical Technologies Inc. v Source Medical Corp. et al, 2017 ONSC 2645 (CanLII):
It is clear that the delay in this case has been inordinate. In Sickenger v. Krek 2015 ONSC 4470 at para. 15; aff’d 2016 ONCA 459 (CanLII), T.M. Wood J. concluded that a delay of 10 years with no action and no contact between counsel was clearly inordinate. Here, the delay is approximately 10 years and 8 months, closer to 11 years.
