I think the plain meaning of this definition is that the words "shown on a strata plan" modify the words "that part of the lands and buildings", so that land and buildings that are shown on a strata plan but are not part of a strata lot will meet the definition. It does not mean, as I think the defence would have me read it, that only those parts of the land and buildings that are shown on the strata plan as being common property are common property. Although the nature of the application was different, Mr. Justice Smith interpreted this definition in the same way in Chan v. Owners, Strata Plan VR‑151, 2010 BCSC 1725 at para. 32.
