Not only did the defendants wrongfully arrest the plaintiff, he says, they also caused him to be maliciously prosecuted in order to give themselves the best defence by way of a good offence (similar to the facts in Holdbak v. Biagioni, [1984] B.C.J. No. 978 (S.C.)), and the defendants are liable.
