In Summach v. Allen, 2002 BCSC 119, affirmed at 2003 BCCA 176, Metzger J. declined to adopt a subjective test for the determination of latent defects. The vendors of a beachfront property sued for the deposit when the purchasers failed to complete after learning there was a nude beach on the adjacent property.
