The deciding court is not to consider the “best interests of the child” in deciding a Hague Convention proceeding. Thomson v. Thomson 1994 CanLII 26 (SCC), [1994] 3 S.C.R. 551 (S.C.C.). The decision to return a child should not be based on a determination of who should have custody.
