The damages for this trespass can fall into two categories: compensatory and punitive. Compensatory damages compensate a plaintiff for losses that can be identified and punitive damages are awarded above and beyond that in order to discourage a defendant and others from high handed conduct that is contemptuous of the plaintiff’s rights. (Rogers v. Landmark [2002] B.C.J. No. 419 (B.C.S.C.)(Q.L.) at ¶ 81.)
