Double costs are a creature of statute and cannot be granted without express power: Evans v. Jensen, 2011 BCCA 279. Rule 9-1(5)(b) allows the court to award double costs in certain circumstances in which an offer to settle has been made. An offer to settle, as that term is defined in Rule 9-1(1) is, however, a pre-condition to an order of double costs.
