The notice of application before the court did not specifically request any sharing of the costs associated with either the actual counselling or the preparation of a written report. The parties agree that responsibility for these costs is a live issue between them. In that respect, neither party was prejudiced by the issue being raised in chambers despite the absence of such relief being sought in the notice of application: Naderi v. Naderi, 2012 BCCA 16.
