The following excerpt is from Marshall v. Strongman, 2001 CanLII 37548 (ON CJ):

[49] By imputing income, the court is able to give effect to the legal obligation on all parents to earn what they have the capacity to earn in order to meet their ongoing legal obligation to support their children. Therefore, it is important to consider not only the actual amount of income earned by a parent, but the amount of income he or she could earn if working to capacity: Van Gool v. Van Gool, supra.
