There have been instances where the court has refused to permit a summary judgment motion after a trial of an issue has been directed; however, those cases are clearly distinguishable: Schwartzentruber v. Schwartzentruber, [2002] O.J. No. 3159 (Sup. Ct.); Knox v. Trudeau, [2001] O.J. No. 352 (Sup. Ct.).
