14. The decision of this Court in Rickard v. The Queen, 1970 CanLII 20 (SCC), [1970] S.C.R. 1022, is an application of this principle. Although that judgment was rendered in connection with a summary conviction, the fundamental principles on which it was based apply equally to indictable offences.
