Finally, it is important to emphasize that the breach of Section 8 that occurred in this case is not related to the fairness of the accused's trial on the substantive charge of assault of a peace officer. Moreover, civil remedies may well be available to the accused (See, Regina v. Tugnum [2002] B.C.J. No. 2556 (B.C.S.C.)).
