The defendants also rely on Buschell v. T & N plc and say that the requirement to show a good arguable case is in addition to those set out in Rule 13(1) which is "an intellectual exercise not requiring any discretion". The onus is on the plaintiff to establish that a reasonable measure of "fairness and justice" in accordance with international comity, will be preserved if the court exercises jurisdiction over the foreign defendants.
