Counsel for the defendants take the position that the subsequent authority cited by the plaintiff was simply a confirmation of previous authority of the same court that was cited to and dealt with by Cumming J. in Scarff v. Wilson, and that I ought therefore to be bound by judicial comity and follow Scarff v. Wilson and the other judgments of this court to the same effect.
